3. User Responsibilities
By using WhistleBlowNG, you agree to act in good faith. You specifically agree to:
- Submit Accurate Information: Ensure that the information you provide is true and accurate to the best of your knowledge.
- No Malicious Reporting: You shall not use the platform to knowingly submit false accusations, manufacture evidence, or pursue personal vendettas.
- Understanding Risks: While we employ top-tier security measures, you acknowledge that whistleblowing carries inherent risks. You agree to take precautions on your end, such as using a secure device and not discussing your report with others.
4. Anonymity & Security
We prioritize your safety. Our platform utilizes end-to-end encryption and does not log IP addresses or identifiable metadata. However, security is a shared responsibility:
- Access Codes: Upon submitting a report, you will receive a unique 16-digit passode. You are solely responsible for keeping this code secure. We do not store a copy of this code; if you lose it, you will lose access to your report and any subsequent communication.
- Device Hygiene: You should clear your browser history after using the platform and avoid using devices monitored by your employer or the entity you are reporting.
5. Intellectual Property
User Content: You retain ownership of any data, text, or files ("Content") you submit. However, by submitting Content, you grant WhistleBlowNG a perpetual, worldwide, royalty-free license to use, reproduce, process, and share such Content with our legal and media partners for the purpose of investigating and reporting on the wrongdoing, subject to our Privacy Policy and anonymity guarantees.
Platform Rights: WhistleBlowNG retains all rights, title, and interest in and to the Platform, including its code, design, logos, and trademarks.
6. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. WhistleBlowNG expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of fitness for a particular purpose. We do not warrant that the platform will be uninterrupted, timely, secure, or error-free, nor do we guarantee any specific legal outcome resulting from your report.
7. Limitation of Liability
To the maximum extent permitted by applicable law, WhistleBlowNG, its affiliates, agents, directors, and employees shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any dispute arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts located in Nigeria.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
